This article is going to take you through the world of Public Liability Insurance including what sort of things are covered in a policy, why you would need to get this type of policy and the sort of trades/occupations that you would need cover for.

First of all let me make this point clear, if you are a single person working alone (for example a single builder or bricklayer) then this is not an insurance policy that is required by law but it is one that you should seriously consider getting before starting work so that you yourself are covered for the work that you will undertake, however if you are a single person at the top of a company that has employees then this is required by law along with Employers Liability Insurance which you can only get together with Public Liability Insurance.

Public Liability Insurance is designed to cover a tradesmen throughout the course of their days work including covering them against any instance of third party property damage or even third party injury, in both of these cases the third party mentioned would be the person you are working for or the property that you have been asked to work upon. These are the main covers that you receive on this type of policy which is why £1,000,000 worth of cover can start from as little as £44.63 for a year of insurance cover.

The third party property damage is the first thing that I would like to talk about including a couple of examples of when this can happen and the things that would be covered. If a carpet fitter was going into a clients house and was to knock over a vase or an expensive antique whilst carrying the carpet through then they would obviously have to pay to replace it hence the insurance and another thing is if a roofer was working on a house and dropped a tile off the roof an it damaged the third parties property in any way then this insurance is there to protect.

Third party injury is the other main thing that you would get Public Liability Insurance to guard against and a good example of this is if a workmen, while in the course of his work, left a tool lying around and the client was to trip over this and injure themselves then the insurance would be there to help. Public Liability Insurance can be obtained for many trades such as builders, Bricklayers, Carpenters, Painters and Decorators, Alarm Installers and Plumbers and many, many more.

52% of UK Engineers are not covered for accidents or injury to the public, according to data from Coverzones, the business insurance comparison and policy management site, which has analysed a sample of 4,500 requests for insurance quotes over a three month period.

Eight in ten civil and structural engineers not covered for public accidents.

According to the Coverzones Engineering Insurance Report, only 48 per cent of engineers looked to purchase public liability insurance in the sample period, followed by just 29 per cent of civil engineers and 22 per cent of engineering consultants. Public Liability insurance covers policy holders against accidents and injury to the public, clients or customers. The implication of the data is that as many as 82 per cent of civil and structural engineers may not be covered for accidental injury.

Simon Ball, CEO of Coverzones: “Although Public Liability insurance is not mandatory for businesses in the engineering profession, considering that their work frequently requires professionals to visit clients on construction sites, it is extremely wise to be protected. You just have to turn on daytime television to see the prevalence of personal injury lawyers and the ease with which a claim can be made. It’s a sad truth that accidents do inevitably happen from time to time and, in an industry where work often occurs in hazardous environments, it is concerning that such a low percentage of companies are enquiring about this type of insurance.”

A third of Civil and Structural Engineers unprotected from cost of professional mistakes.

In the three month period, Coverzones data also revealed that just 65 per cent of civil and structural engineers had actively enquired about Professional Indemnity insurance, suggesting that 35 per cent may not be covered. This type of insurance protects policy holders against claims from clients who suffer a financial loss or damages due to negligence, breach of care or error in professional advice. 57 per cent of civil engineers, 56 per cent of engineering consultants and just 29 per cent of design consultants enquired about Professional Indemnity insurance in the three month sample period.

Although there is no official requirement from engineering bodies for companies to hold professional indemnity insurance, it is strongly recommended. It is often the case that engineers are required to hold and maintain cover to meet with clients’ contractual requirements and collateral warranty agreements anyway.

Ball continued: “It’s staggering, in an industry that’s been hit so hard by the recession, that such a high proportion of professionals are not protecting themselves. Imagine a situation where you might be chasing a client for unpaid fees and they file a counter claim alleging, for example, that you’d given a misleading estimate in order to delay or reduce their payment. Without Professional Indemnity insurance, you would have no recourse. Consider also that Chartered Engineers are often involved in calculations and planning of multi-million pound developments – a claim from just a single mistake could well cripple a business.”

“Organisers can purchase different levels of cover, from £1m up to more than £10m. How much they need will vary according to the type of event and the number of people going, but we recommend that you contact your local council first as some authorities have taken out blanket cover on behalf of all street parties in their area or have dropped the insurance requirement entirely, and if you live in an area where you need a local authority licence for your event, PLI may be a requirement.”

“As with most types of insurance cover it’s really a case of planning for the unknown. In terms of what can go wrong, the overall risks at street party events are usually quite low, but that’s not to say a claim won’t arise from injury or property damage during the party.”

“Street parties are a fun and celebratory event, they are not inherently dangerous events therefore in most cases it’s the slips, trips and falls (both during the event and setting up) that can cause event organisers legal issues.”
